Can my child use AI for homework? There is no national rule, only the school's

It is the September question in a lot of homes, and the answer most people expect is an official yes or no. It does not exist. We checked the official sources of three European countries on 1 August 2026, and in none of them is there a national rule on whether a pupil may use AI for homework.

What does exist are recommendations

The difference matters, because it decides who you have to ask. A recommendation is addressed to the education administration and to schools. It is not a rule a child could break.

Germany's education ministers adopted such a recommendation on 10 October 2024, addressed expressly to the education administration. Austria's ministry puts it plainly: pedagogical responsibility stays clearly with the teacher. The pattern repeats wherever we looked. The national level gives orientation, the school decides, the teacher applies. Which is why two classes in the same building can run different rules without either being out of line.

The four questions that help

Asking the school beats hunting for the regulation, because the rule that affects your child is the one in the classroom. These four fit in one email and head off most of the year's misunderstandings:

• Which tasks may it be used for, and which not?
• Does its use have to be declared, and in what form?
• What happens if a teacher suspects a text came from an AI?
• Which specific tool does the school recommend or allow?

What gets decided at home

Even where the school says nothing, something simple can be agreed at home: AI comes before the writing, to understand and to sort out, not afterwards to fill the page. A child who has a topic explained and then writes it themselves learns. One who has the text handed over submits something they cannot defend when asked about it in class.
